NOT INCREASE YOUR CHANCES OF WINNING. Allivet Happy & Healthy Pet Photo Contest (the “Contest”)
begins at 10 AM Eastern Time (“EST”) on Monday, October 1, 2012, and ends on
Friday, October 26, 2012 at 11:59 PM Eastern Time (“EST”) (the “Promotion
Period”).
ELIGIBILITY: To
participate in this Contest, you must be a legal resident of the 50 United
States or the District of Columbia, be at least 18 years of age, and be the
legal owner of a living cat, dog or horse at time of entry. Employees of
Allivet, Facebook, Inc., their affiliates, subsidiaries, advertising and
promotion agencies, vendors, employees and immediate family of such employees
(defined as spouse, IRS dependent, or biological, adoptive or step- mother,
father, sister, brother, daughter or son, and each of their respective
spouses), or those who reside in the same household as any person in any of the
preceding categories, are not eligible to participate. Void outside the 50
United States and D.C. and where prohibited.
HOW TO ENTER: To
enter the Contest, a qualified entrant must visit the Allivet Facebook Fan Page
at www.facebook.com/Allivet (the “Website”), click on the Contest tab in which
qualified entrant will need to complete the online entry form in its entirety
and upload a photo of entrant’s pet dog, cat or horse along with 50 word short
story of how the pet lives a healthy lifestyle (the “Photograph” and the
“Explanation”), and submit (the “Entry”).
CONTEST ENTRY CRITERIA:
Each Photograph must meet the following content restrictions:
• The Photograph must not contain
material that violates or infringes another’s rights, including but not limited
to privacy, publicity or intellectual property rights, or that constitutes
copyright or trademark infringement;
• The Photograph must not contain
material that is inappropriate, indecent, obscene, hateful, tortuous,
defamatory, slanderous or libelous;
• The Photograph must not contain
material that promotes bigotry, racism, hatred or harm against any group or
individual or promotes discrimination based on race, sex, religion,
nationality, disability, sexual orientation or age;
• The Photograph must not contain
material that is unlawful, in violation of or contrary to the laws or
regulations in any state where the Entry is created.
For all Entries: By
submitting a Photograph, you warrant and represent that: (a) it is your
original work and has been legally created; (b) it has not been previously
published or distributed in any media; (c) it has not been entered in or won
previous Contest or awards; (d) it does not infringe upon the copyrights,
trademarks, rights of privacy, publicity or other intellectual property or
other legal or moral rights of any person or entity; (e) you own all rights to
your Entry, including without limitation, copyrights; (f) publication of the
Entry via various media including Web posting, will not infringe on any third
party rights; (g) you are the legal owner of the pet featured in the Photograph
and have received permission from any other individuals pictured in the Photograph
to submit the Photograph in this Contest; and (h) you will indemnify and hold
harmless the Sponsor, Allivet and related entities or agents from any claims
and damages (including reasonable attorneys’ fees) arising from or relating to
the breach or alleged breach of your representations and warranties herein,
your Photograph, or your conduct in creating your Photograph or otherwise in
connection with this Contest. Sponsor reserves the right to remove, reject or
disqualify (along with the Entrants who submitted them) any Entry which, in its
opinion or the opinion of the judges, violate any of these Official Rules or
are otherwise inappropriate.
In the event of a dispute, Entries will
be deemed made by the authorized account holder of the e-mail address submitted
at the time of entry. The “authorized account holder” is deemed the natural
person who is assigned to an e-mail address by an Internet access provider,
service provider or other online organization that is responsible for assigning
e-mail addresses for the domain associated with the submitted e-mail address.
Entries made by any other individual or entity that is not the person named on
the submitted Entry, or made in any manner inconsistent with these Official
Rules, will be declared invalid and disqualified from this Contest.
DURATION: This
Contest begins at begins October 1st 2012, 10 AM Eastern Time (“EST”)
on ends on October 26, 2012 at 11:59 PM Eastern Time (“EST”) (the “Promotion
Period”). For an entry to be eligible, it must be registered within this time
period. Only one entry per person, address or e-mail address is permitted over
duration of Contest.
PRIZES: The following
Prize(s) will be awarded based on a two-tiered community voting then
judge-based selection from eligible entries received:
Prize is non-transferable and
non-redeemable for cash. Prize winner is solely responsible for any
fees/incidentals not included in the prize(s) that become due with respect to
prize. Sponsor is not responsible for lost or stolen prizes once they are awarded.
Finalist winner(s) will be determined
by a popular vote selection by Allivet Facebook Fans from all eligible entries
received. Eligible entries include only those entries that are submitted by
Allivet Facebook fans. Non-fans are not eligible. Odds of winning depend on the
number of eligible entries received. By participating in this Contest, entrants
agree to be bound by these rules and by the decisions of the Sponsor and
Contest Administrator which is final in all matters relating to this Contest. Winner
will be notified by e-mail. Two (2) attempts will be made to notify winners
within 72 hours. If a winner does not respond within 72 hours, an alternate
winner may be selected from all remaining eligible entries, in the sole
discretion of the Sponsor. Winners will also be announced on Facebook. Winners
will have 72 hours from notification to accept the prize. Sponsor is not
responsible for and shall not be liable for late, lost, misdirected, or
unsuccessful efforts to notify winner. If a potential winner cannot be reached
via their e-mail address or if he/she is found to be ineligible, or if he/she
cannot or does not otherwise comply with these Official Rules, an alternate
winner will be selected. All entries become the exclusive property of Sponsor and
will not be acknowledged or returned.
TERMS AND CONDITIONS: No
transfer, substitution or cash value equivalent for any prize is available,
except at sole discretion of Sponsor. This Contest is subject to all applicable
federal, state, and local laws. All federal, state, or other tax liabilities,
if applicable, are the sole responsibility of the prizewinner. By
participating, entrants agree to be bound by these Official Rules and the
decisions of the Sponsor, judges and Independent Contest Administrator, and
waive any right to claim ambiguity in regard to the Contest mechanics, and/or
the interpretation of these Official Rules. All entrants, and any selected
winners, agree to release, discharge, indemnify and hold harmless the Sponsor,
Facebook, Inc., any vendors/prize providers that may be associated with this
Contest, and the respective officers and employees of these entities, from and
against any claims, damages or liability due to any injuries, damages or losses
to any person or property of any kind resulting in whole or in any part,
directly or indirectly, from participation in this Contest, or for any prizes
won.
RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Contest, participants agree to
release and hold harmless Sponsor, Facebook and their related companies,
subsidiaries, affiliates, directors, officers, employees, and agents from any
and all liability for any injuries, loss, or damage of any kind arising from or
in connection with this Contest or any prize won, including any injuries, loss
or damage of any kind arising from or in connection with participation in the
Contest. Sponsor is not responsible for any typographical or other error in the
printing of this offer, administration of the Contest or in the announcement of
prizes. In the event Sponsor is prevented from continuing with this Contest, or
the integrity and/or feasibility of the Contest is undermined by any event
including but not limited to fire, flood, epidemic, earthquake, explosion,
labor dispute or strike, act of God or public enemy, satellite or equipment
failure, riot or civil disturbance, war (declared or undeclared), terrorist
threat or activity, or any federal, state or local government law, order or
regulation, order of any court or jurisdiction, or other cause not reasonably
within Sponsor's control (each a "Force Majeure" event or
occurrence), Sponsor shall have the right, in its sole discretion, to
abbreviate, modify, suspend, cancel, or terminate the Contest without further
obligation and, if so, Sponsor reserves the right, but not the obligation, to
award the prize from among all valid and eligible entries received up to the
time of such Force Majeure event. All entries are the property of Sponsor and
are not returnable. The laws of the Commonwealth of Florida (USA), without
regard to its conflict of law rules, will govern these Terms. Any action
relating to this Contest shall be initiated only in the state and federal
courts located in Dade County, Florida (USA).
DISPUTES: Except
where prohibited, entrant agrees that any and all disputes, claims and causes
of action arising out of, or connected with, the Contest or any prize awarded
shall be resolved individually, without resort to any form of class action, and
exclusively by the appropriate court located in the Commonwealth of Florida.
All issues and questions concerning the construction, validity, interpretation
and enforceability of these Official Rules, entrant's rights and obligations,
or the rights and obligations of the Sponsor in connection with the Contest,
shall be governed by, and construed in accordance with, the laws of the
Commonwealth of Florida, without giving effect to any choice of law or conflict
of law or conflict of law rules (whether of the Commonwealth of Florida or any
other jurisdiction), which would cause the application of the laws of any
jurisdiction other than the Commonwealth of Florida.
Winners List and Official Rules: Winner may be posted at Facebook, Twitter and/or other
social media properties after winner is notified and eligibility is confirmed.
